Holiday Participation
You and your party must understand and accept that all of our properties are strictly Non Smoking.
You and your party must undertake to behave in an orderly fashion and not to disrupt the enjoyment of others or prejudice Whistler Holidays reputation. We reserve the right to immediately terminate the holiday of any client whose behaviour is such as in our opinion or in the opinion of any other person in authority does or is likely to cause distress, danger or annoyance to other clients, employees, or to any third party or damage to property. In the event of such termination, our responsibility to the client concerned immediately ceases and we will have no further contractual obligations toward the person including the return travel arrangements. We shall further be under no liability to make any refunds or meet any costs or expenses incurred as a result or pay any compensation. Whistler Holidays or its employees shall be entitled to recover from the client the cost (estimated if not precisely known) of any damage or loss caused by the client. If the captain of your aeroplane believes that you could be disruptive, he can refuse to let you fly. If this means you are not allowed to board the flight to your holiday resort, we will treat your booking as cancelled from that moment, and you will have to pay full cancellation charges.

Air Fares
We leave you to source these in order to take advantage of the numerous special offers available. We can recommend Arcade Travel of 50 High Street, Wick, Caithness, Scotland KW1 4BS Tel 01955 604845. Having used their services for the past eight years, we are confident that they can find the best deals available.

Insurance
Proper insurance cover is essential for a ski holiday in North America. Insurance is mandatory for every booking, and unless you confirm on the booking form that you have arranged insurance cover giving details of your insurers, we will not be able to accept your booking.

Duration of your Holiday
The number of nights shown in your booking form are those for which accommodation will be reserved for you. Where rate changes apply across stated dates, we will pro-rate the cost. All holidays will involve a night spent on the aircraft on your return journey to the UK. This is in addition to the number of nights shown in the accommodation confirmation.

Visa
A British citizen with a valid ten year passport does not need a visa to visit Canada for up to 90 days. If you require a visa to enter into Canada, please check with the High Commission. We can not be held responsible if you do not properly equip yourself or any member of your party.

Payment
This can only be made by Visa credit card, Canadian dollar traveller's cheques, or money transfer.


Terms and Conditions

 

Your contract will be with Whistler Holidays.

1 When you make your booking you must:
· Complete a booking form, accepting on behalf of the whole party the terms of these booking conditions
· and pay a minimum of 2 nights deposit.

2 By signing the booking form you indicate that you have :
· read and understood these booking conditions and the other information printed in our brochure.
· have the authority of all persons named in the booking form to enter into a contract with us on their behalf.

3 No contract will exist between you and us until:
· we have received your fully completed booking form together with the appropriate deposit and
· we issue and post our confirmation invoice to you.

4 The balance of the price of your holiday must be paid at least eight weeks before your departure date. If the balance is not paid in time we reserve the right to cancel your holiday, retain your deposit and apply cancellation charges as set out below.
FOR BOOKINGS MADE LESS THAN EIGHT WEEKS FROM DEPARTURE THE FULL HOLIDAY PRICE MUST BE PAID AT THE TIME OF BOOKING

5 All communications from us to you will be sent to the address stated by you on the booking form.

6 If, after our confirmation invoice has been issued, you wish to change to another of our holidays, or change your departure date, we will endeavour to make the changes, provided that written notification is received at our offices from the person who signed the booking form at least eight weeks before your departure date. ANY ALTERATION BY YOU WITHIN EIGHT WEEKS OF DEPARTURE WILL BE TREATED AS A CANCELLATION OF THE ORIGINAL BOOKING AND WILL BE SUBJECT TO THE CANCELLATION CHARGES SET OUT IN CLAUSE 7.

7 You, or any member of your party, may cancel your holiday at any time providing that the cancellation is made by you in writing. We will retain your deposit and where the cancellation is within 60 days of departure, we will apply the following cancellation charges:

If your reason for cancellation is covered under the terms of an insurance policy, you may be able to reclaim these charges (less any policy excess) the insurance premium is non-refundable

8 Should you wish to curtail any arrangement or change your itinerary during the course of your holiday then any extra cost shall be born by you and paid for locally.

9 If you have a problem during your holiday please inform us immediately and we will make every effort to put things right as quickly as possible. Should we be unable to achieve a satisfactory solution you should then write to us within 28 days of your return, quoting your booking reference number.

10 Once we have issued our confirmation invoice, the price of of your holiday is fully guaranteed intill May 2006.

11 In the unlikely event that we will have to make any changes to your holiday, they will be minor. We will notify you at theearliest opportunity, transfer carriers may be subject to alteration beyond our control. If a major change to your holiday becomes necessary we will notify you as soon as possible. Provided the major change does not arise from circumstances beyond our control or by Force Majeure, you may choose
a) to accept the change of arrangements
b) to cancel your holiday
In all cases of major change we will pay compensation as set out below.

Important notice
a) No compensation will be paid or opportunity to cancel given, if the major change was notified to you prior to booking.
b) Major changes include cancellation and accommodation changes to inferior standard accommodation.
c) Minor changes include accommodation changes to a comparable or superior standard.
d) Compensation will not be payable if we are forced to cancel, or in any way change your holiday due to Force Majeure - war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or seriously adverse weather conditions or any event beyond our reasonable control.

12 We reserve the right in any circumstances to cancel your holiday. However in no case will we cancel your holiday less than eight weeks before the scheduled departure date except for reasons of Force Majeure or failure on your part to pay the final balance. In circumstances where we are unable to provide the holiday booked, we will return to you all money paid plus compensation as listed in clause 11.

13 We accept responsibility for ensuring the holiday which you book with us is supplied as described in this brochure and the services offered reach a reasonable standard. We will not accept liability arising from the negligence of our suppliers, sub contractors, servants and or agents.

14 If you suffer death, illness or injury by misadventure whilst overseas arising out of activity which does not form part of the foreign inclusive holiday arrangement or excursion arranged through us, we shall at our discretion offer advice, guidance and assistance to help you in resolving any claim you may have against a third party, (provided any assistance is requested within 30 days of the incident occurring). Where legal action is contemplated for which our assistance is required our authority must be obtained prior to commencement of proceedings and be subject to your undertaking to assign any costs recovered or any benefits received under an appropriate insurance policy to ourselves. Our Costs in respect of the above on behalf of you and your party shall not exceed £5,000 in total.

15 When you travel with the carrier, the conditions of carriage of the carrier apply, some of which may limit or exclude liability. The responsibility of I.A.T.A airlines is limited to the carriage of you and your baggage in accordance with their conditions of carriage.

16 Any booking made with our programme in connection with APEX fare travel shall be handled strictly in accordance with the conditions published in connection with these fares. It is your responsibility when making the reservation in connection with APEX fares to ascertain the exact terms and conditions. Please note that in accordance with air navigation orders, an 'infant' is classed as under 2 years of age as at the date if his/her return flight, and a 'child' is classed as over 2 but under 12 years of age, as at the date if his/her return flight.

17 It is your responsibility to ensure that passports, visas and other necessary travel documents are valid and available on departure. You must ascertain the health requirements for the particular holiday you have chosen. If you have any doubt whatsoever about your state of health in conjunction with any aspect of the holiday it is imperative that you consult your own doctor immediately. You may also refer to the Department of Health leaflet; The Travelers Guide to Health.

18 This contract is made on the terms of these booking conditions which are governed by Canadian Law and both parties shall submit to the jurisdiction of the Canadian Courts at all times
